- Presentation - by Mitch Avalon, Deputy Director of Contra Costa County Public Works, on the new creek signage program "Stay Out - Stay Alive" introduced by the County Board of Supervisors. Introduction by Mayor Hoffmeister.
- ANNOUNCEMENTS
CITY COUNCIL MATTERS - CITY COUNCIL CONSENT ITEMS:
- Approving - minutes for the meeting of September 27, 2011. (No Fiscal Impact) Recommended by the City Clerk.
- Adoption of Ordinance No. 11-5 - an amendment of the Concord Municipal Code amending Chapter 38, (Health and Safety), Article II (Smoking in Public Places and Workplaces) regarding a smoking ban in all areas accessible to the general public within the Parking In-Lieu District in the downtown. Ordinance No. 11-5 was introduced on September 27, 2011.
- Adoption of Ordinance No. 11-7 - an amendment of the Concord Municipal Code repealing in its entirety Chapter 118, (Vehicles for Hire), Article II (Public Motor Vehicles) and adding a new Chapter 118, (Vehicles for Hire), Article II (Taxicabs) regarding the regulation of taxicabs operating within the City of Concord. Ordinance No. 11-7 was introduced on September 27, 2011.
- Matters to be set for Public Hearing - on Tuesday, November 1, 2011 at 6:30 p.m. in the Council Chamber:
1) Consideration - of an Ordinance amending the Concord Municipal Code Chapter 122 (Zoning), Article III (Districts and District Regulations), Division 2 (R-6, R-7, R-7.5, R-8, R-10, R-12, R-15, R-20, R-40 Single Family residential Districts), Section 122-310 (Secondary Living Units) to add provisions for discretionary approval of secondary living units up to 1,000 sq. feet and two bedrooms in size. Recommended by the Planning Commission.
2) Consideration - of an ordinance amending the Concord Municipal Code Chapter 2 (Administration), Article VIII (Purchasing), to update and amend various provisions. Recommended by the Director of Finance.
3) Consideration - of the summary vacation of portions of two excess right-of-way properties as follows: a) approximately 3,175 sq. feet of property located at 2151 Arnold Industrial Way (a portion of APN 159-080-028) and b) approximately 33,131 Sq. feet of property located at 1850 Solano Avenue (a portion of APN 112-240-011, 012 and 013). Recommended by City Engineer. - Approving - the total expenditure for Fiscal Year 2011-12 with Skyhawks Sports Academy, Inc., a Sports Camps Consultant, in the amount of $22,729. (Funded by program fees) Recommended by Director of Parks and Recreation.
- Accepting - the improvements for Project No. 2175 (Ygnacio Valley Road Repair - Phase 3) constructed by Thunder Mountain Enterprises, Inc.; and direct the City Clerk to file a Notice of Completion. (No Fiscal Impact.) Recommended by City Engineer.
- Approving - a Professional Services Agreement with George Hills Company to provide Third Party Administrator services for a three-year period in the total amount of up to $40,000 annually; and authorizing the City Manager to execute the agreement. (General Funds) Recommended by City Attorney.
- Approving - the Fourth Amendment to the Professional Services Agreement with Gates & Associates of San Ramon for an extension of time to provide construction management and facility start-up services for Project No. 1288 (Meadow Homes Spray Park Improvements); and authorize the City Manager to execute the agreement. (No Fiscal Impact.) Recommended by City Engineer.
- Accepting - the improvements for the 2010-11 Surface Seal Program, RFB #2211 constructed by Valley Slurry Seal Company; and direct the City Clerk to file a Notice of Completion. (No Fiscal Impact) Recommended by City Engineer.
- Authorizing - the appointment of Barbara Gomez and Judi Waterson to serve as the City's representatives to the Contra Costa County Library Commission as Member and Alternate member, respectively, for a two-year term ending June 30, 2013. (No Fiscal Impact) Recommended by City Clerk.
- CITY COUNCIL CONSIDERATION ITEMS:
- Consideration - of staff recommendations for addressing labor policy issues raised in Council Resolution No. 10-10 associated with the amendment of the adopted Reuse Plan into the 2030 General Plan. Recommended by the Council Subcommittee on Policy Development and Internal Operations. (No Fiscal Impact.) Report by Reuse Project Director.
Staff Recommendation: Hear the report; take public testimony; approve staff recommendations, provide direction to staff on policy language or implementing resolutions which staff will bring back to the Council for its approval in the future as part of the adoption of the Concord Reuse Project Area Plan or just prior to property transfer.

NEXT REGULAR CITY COUNCIL MEETING: Tuesday, November 1, 2011.
CLOSED SESSION: The City Council may convene in closed session immediately prior to or at the conclusion of the above meeting. Notice to Public
Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.
ADA Notice and Hearing Impaired Provisions: The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24). Televised Meetings: All meetings are broadcast live on Comcast channel 28, Astound Broadband channel 29, and AT&T U-Verse channel 99. The meeting is replayed on the Wednesday following the meeting at 8:00 a.m., 2:00 p.m. and 7:00 p.m. Replays are also broadcast on Thursday, Friday and Saturday.
